Your purchase of subscriptions to the CPD Foundation will be subject to our general terms and conditions, the RICS Training and Events Special Conditions and these Special Conditions also. You should read all of these documents together. Unless otherwise stated in these Special Conditions, the defined terms in our general terms and conditions and the RICS Training and Events Special Conditions shall apply here also.
In the event of any conflict or inconsistency between these three documents, they shall apply in the following order of precedence:
1. Term and Scope of Subscription
1.1. When purchasing the subscription package, you will be required to nominate an individual within your organisation as your “Key Contact”. Discounted rates are available for multiple subscription purchases and these are only available to organisations. Individuals cannot join together to obtain a discounted rate. Where you are purchasing as an individual, you will be the Key Contact. The Key Contact will be responsible for managing the subscription and will be required to nominate the individuals within your organisation that you wish to have access to our seminars and associated 'On Demand' material (each individual being a “Subscription User”).
1.2. Each subscription package shall be for a term of 12 months (or such term as stated within the order confirmation). This shall commence from the date we receive payment in full from you (and for the avoidance of doubt not from when the Key Contact nominates the Subscription Users) and will automatically expire at the end of that period subject to any renewal.
1.3. Where you purchase additional subscriptions during the course of your original subscription term, we reserve the right to treat these as separate and discrete purchases and you will not usually be entitled to claim any discounts offered based on previous purchases.
2. Change of Subscription User
2.1. Each Subscription User shall have a right to attend as many of the CPD Foundation’s seminars and view associated 'On Demand' content as they wish to during the term of your subscription subject to availability.
2.2. You are not entitled to transfer subscriptions between individuals within your organisation or to transfer them to anyone else without our express written agreement (which shall be at our sole discretion). We reserve the right to refuse access to any individual that is not a Subscription User.
3. Booking and cancellation of seminar places
3.1. The Key Contact (or your Subscription Users) will be required to book a place in respect of each Subscription User that wishes to attend a given seminar in advance of their attending.
3.2. You may cancel a booking provided that you give us at least [24 hours’] notice in each instance.
3.3. A substitute Subscription User may attend a seminar in place of the Subscription User that originally booked provided again that you give us at least [24 hours’] notice.
3.4. We reserve the right to review and at our discretion terminate your subscription immediately in the event of the following:
3.4.1. If Subscription Users repeatedly fail to attend seminars without cancelling their places;
3.4.2. If you repeatedly fail to provide at least [24 hours’] notice of any cancellation or permitted substitution;
3.4.3. If we reasonably believe that you are unreasonably exercising your right of cancellation (for example, if you were to routinely book places to secure your attendance but without any firm intention to attend at the time of booking).
3.5. For the avoidance of doubt, this clause 3 relates solely to your booking and cancellation of places at specific seminars. For details of your rights of termination in relation to your subscription package as a whole please refer to the RICS Training and Events Special Conditions.
